Gov. Roy Cooper and Attorney General Josh Stein filed briefs asking the N.C. Court of Appeals to uphold a ruling that blocks a proposal to change how many—and how—N.C. Board of Elections members are selected.

Currently, the governor appoints five NCBOE members with input from legislative leaders. Passage of Senate Bill 749 would transfer this authority to legislative leaders and increase the number of NCBOE members to eight seats split evenly among Republicans and Democrats.

The current odd number enables sitting governors to weigh the NCBOE toward their party.

In March, a unanimous three-judge trial court panel ruled in Cooper’s favor. The state Supreme Court rejected an attempt to create a bipartisan elections board in 2018, and voters defeated a constitutional amendment addressing the issue that year as well.

Article Icon 1Election Watch: Citizens-Only Constitutional Amendment

A North Carolina Constitutional amendment on this year’s ballot asks voters to choose whether they are “for” or “against” revised language surrounding who can vote in state elections.

The amendment replacesEvery person born in the United States and every person who has been naturalized” with “Only a citizen of the United States,” then continues with “who is 18 years of age and otherwise possessing the qualifications for voting shall be entitled to vote at any election in this State, except as herein otherwise provided.”

In a related matter, the U.S. Department of Justice failed to respond to a congressional request for answers regarding cases of illegal immigrants registering to vote in North Carolina and other states.

Also, the U.S. Court of Appeals for the 4th Circuit unanimously ruled Tuesday that it was “improper” for a district judge to send a national and state Republican case back to state court that alleges that up to 225,000 North Carolina voters failed to provide proof of citizenship when registering to vote. The challenge will remain in federal court.

Article Icon 133 Counties Switch to Debit Jury Duty Payments

Jurors in 33 North Carolina counties will begin receiving prepaid debit card payments instead of paper checks for jury service by the end of October.

By January 2025, 100 counties are expected to switch to debit payments.

Counties making the change this month include Alamance, Brunswick, Burke, Cabarrus, Caldwell, Carteret, Catawba, Cumberland, Dare, Davie, Duplin, Franklin, Gaston, Graham, Guilford, Iredell, Jackson, Lee, Lenoir, New Hanover, Onslow, Orange, Pender, Randolph, Rowan, Sampson, Stanly, Surry, Transylvania, Union, Wake, Wilkes, and Yadkin.

The North Carolina Administrative Office of the Courts switched to debit payments as part of efforts to improve efficiency and adopt paperless processes.
